Two firms that provide foreign satellite football to pubs have won the right to argue their defence in court in civil prosecutions brought by the Premier League (PL).
The defence mounted by QC Leisure and AV Station PLC will now be heard in April at the High Court in the Strand, London.
The PL is taking civil action against the firms for breach of copyright for broadcasting Premier League games.
The PL had applied to the High Court for the defence to be “summarily disposed” so they would not get heard in court.
But Mr Justice Barling ruled the defences should be heard and trials are now set for April.
The PL pointed to a precedent set by previous trials involving Belgium-based cable TV firm called Coditel, which picked up broadcasts from EU member states and supplied them to its subscribers.
The satellite suppliers argued that these precedents do not apply as the broadcasts are done in a different way.
