High Court judges have ruled against Karen Murphy in the landmark foreign satellite case.
The case gives the clearest indication yet that the use of foreign satellite systems to screen Premiership football games is illegal.
Murphy, of the Red, White & Blue in Portsmouth, was appealing against her conviction for screening Premiership football via Greek channel Nova Supersport.
The Premier League welcomed the High Court’s decision to dismiss Murphy’s appeal.
Premier League spokesman, Dan Johnson, said: “We are extremely pleased that the High Court has endorsed the judgments of the Crown and Magistrate Courts as well as the position consistently presented by the Premier League and Media Protection Services to the licensed trade.
“We hope that licensees and others will now heed the advice of the Courts and accept that the use of foreign satellite systems to screen Premier League football in the UK is copyright theft, pure and simple.
“It has never been our desire to prosecute individual licensees, but where the law has been repeatedly ignored we have been left with little choice but to seek recourse to the Courts. This will remain the case going forward.
"We will also continue our actions against the suppliers of illegal foreign satellite systems, and would welcome any information from the trade regarding either of these activities.”

27 June'06: Acquited by Judge Arnold as she had not received the transmission dishonestly. She had a letter from her brewery Gales recommending she took the Nova system.
26 Jan'07: Found guilty of two offences relating to breaching the FA Premier League's copyright at Crown Court by Judge Arnold. Fined £8,000.
15 March'07: Appeals decision in Crown Court. Conviction upheld by Judge Iain Pearson.
29 Nov'07: High Court appeal
21 Dec'07: High Court judges dismiss appeal

this is total shite
EVERY sky outlet also sells euro systems, its easier to pick up a 'real' satellite system than it is a sky system, so are they now saying that they will also deny the general public the right to choose?
everybody grab a copy of what satellite and report every trader in there to them, theyll be snowed under and realise they cant win
off to the EU courts
and if everyone at the MA is off for xmas, how come stories still appear?

I suspected Karen will lose her case as the UK law system always rule in favour of large corporations with ££££££. So what happens now? Is Karen going to appeal again to the House of Lords? What are ESTA's plans to combat prosecutions? Is the legal defence plan still valid?

I just read the BBC News story and it seems that Karen Murphy's case is far from over. The judge may have ruled that BSkyB only have the rights to show live matches in the UK, but the case is going to be reopened next year to see whether free movement legislation and competition laws in the EU may affect the ruling against Karen. Lets hope so.

I also have a legal defence plan. I am assuming until the ruling next month, this will still be applicable then?
Whta will happen after next month when the other parts of the appeal are looked at? Again will the legal defence plan still take us through if it goes before the EU?
Anyone any ideas? |

We have spoken to Karens defence team and the situation is unchanged. We have been advised to carry on showing football in pubs and that we are still doing nothing wrong. This part of the judgement was not unexpected. |

Thank you for that information. Just another quick note, will you keep us updated on here if that situation changes?
Obviously i aswell as others have been following the case, but you know what sky are like, the first sniff of something in there favour and they are on to you like flies!!
I know the insurance people should let us know, but obviously, people who have more of a background on the case will have more of an idea how things will pan out.
