(26-09-2008 20:05:32)</title><author>Only England</author><link>http://lamps.forumco.com/topic.asp?TOPIC_ID=67</link><ttl>10</ttl><pubDate>Fri, 26 Sep 2008 20:05:32 +0100</pubDate><description><![CDATA[ Any news?]]></description></item><item><title>Bolton Pubs visited today (07-08-2008 00:36:32)</title><author>Head Lamp</author><link>http://lamps.forumco.com/topic.asp?TOPIC_ID=65</link><ttl>10</ttl><pubDate>Thu, 7 Aug 2008 00:36:32 +0100</pubDate><description><![CDATA[ A lot of pubs have been "warned" today by MPS that showing DIGIALB football will make them liable to prosecution.<br /><br />Pubs visited were told that they had been witnessed showing Bolton wanderers matches on the 14th April 2008 via the Digialb channels.<br /><br />It was inferred to all the pubs, that the outcome of the European court cases (Murphy, QC Leisure) would have no bearing on DIGIALB prosecutions, as Albania is outside the EU.<br /><br />Maybe a new tack from MPS......... <br />]]></description></item><item><title>Karen Murphy (24-06-2008 20:03:07)</title><author>lamps</author><link>http://lamps.forumco.com/topic.asp?TOPIC_ID=58</link><ttl>10</ttl><pubDate>Tue, 24 Jun 2008 20:03:07 +0100</pubDate><description><![CDATA[ Karen Murphy wants her case referred to the European Court of Justice.<br /><br />The second part of the Murphy case kicked off this afternoon – hot on the heels of this morning’s decision by a High Court judge to refer the landmark battle between the Premier League and foreign satellite suppliers AV Station and QC Leisure to the European Court of Justice.<br /><br />Round one went against Murphy of the Red, White & Blue in Portsmouth, who was appealing against her conviction for screening Premiership football via Greek channel Nova Supersport.<br /><br />“We say a reference is justified and the judgment this morning strengthen’s our issue,” said QC Martin Howe.<br /><br />However, counsel for Media Protection Services opposed any aspect of the case being referred to the European Court.<br /><br />He told the judges there were some 50 live prosecutions standing adjourned pending a court ruling in Murphy’s case.<br /><br />The hearing is set to run for a further two days in front of Lord Justice Stanley Burnton and Mr Justice Barling.<br /><br />Case history: Murphy’s law<br />27 June’06: Acquitted by Judge Arnold as she had not received the transmission dishonestly. She had a letter from her brewery, Gales, recommending she took the Nova system.<br />26 Jan’07: Found guilty of two offences relating to breaching the FA Premier League’s copyright at Crown Court by Judge Arnold. Fined £8,000.<br />15 March’07: Appeals decision in Crown Court. Conviction upheld by Judge Iain Pearson.<br />29 Nov’07: High Court appeal commences.<br />21 Dec’07: High Court judges Lord Justice Pumfrey and Mr Justice Stanley Burnton dismiss appeal.<br />24 Dec'07: Lord Justice Pumfrey dies<br />24 June'08: Murphy European hearing begins.<br /><br /><br /><br />COMMENTS]]></description></item><item><title>Breaking News 24/06/2008 (24-06-2008 17:17:31)</title><author>lamps</author><link>http://lamps.forumco.com/topic.asp?TOPIC_ID=57</link><ttl>10</ttl><pubDate>Tue, 24 Jun 2008 17:17:31 +0100</pubDate><description><![CDATA[ The judge in the landmark High Court battle between the Premier League and foreign satellite suppliers AV Station and QC Leisure has referred the case to the European Court of Justice.<br /><br />The case could now drag on for another two years while it takes its place in a lengthy queue.<br /><br />The Premier League was seeking a ban on importing, selling, hiring, advertising, installing and maintaining decoders.<br /><br />The defendants denied breaking copyright law and claim that the attempt to stop them selling the decoder cards is in breach of the EC Treaty, which guarantees the right of free trade between member states.<br />The issues in this case have at their heart the proper interpretation of a number of instruments of Community legislation concerning the cross-border broadcasting of television programmes by satellite,” said Mr Justice Kitchin.<br /><br />”I believe the issues which I have identified and upon which the assistance of the Court of Justice is sought are so fundamental that they should be considered as a whole by the Court at the earliest opportunity.”<br /><br />Delighted<br />Paul Dixon of Molesworths, Bright and Clegg, who represented AV Station, said: “The importance of this test case cannot be overstated. <br /><br />“We satisfied the court that there is a significant demand for the reception of satellite broadcasts in Member States outside the state of origin, for a variety of reasonable purposes, including a demand by Premier League clubs themselves who had installed foreign satellite systems in order to look at match broadcasts of both FA Premier League and foreign league games for player analysis and scouting purposes. <br /><br />"Kitchin J readily acknowledged that this litigation could have significant consequences for the European broadcasting market.<br /><br />“From the outset we have asserted that the issues which we have raised in relation to EC competition and free movement laws should be considered by the European Court of Justice. <br /><br />"I am delighted that Kitchin J accepted our submissions and has chosen to refer the issues straight to the ECJ.”<br />Premier League reaction<br /><br />A Premier League spokesman said: “The Premier League respects the right of Mr Justice Kitchen to refer to the European Court of Justice and is encouraged to see the court has accepted the strength and substance of our arguments.<br /><br />“Our stance on the illegal supply and use of foreign satellite equipment to broadcast Barclays Premier League football has been unequivocal and we relish the opportunity for a definitive ruling at the highest possible level, in order to end the confusion we know this issue causes in the licensed trade.”<br /><br />Process<br /><br />When the European Court has reached a decision the matter will then have to return to the High Court here for a decision after which it will be open to either side to mount appeals – a process again which could take years to exhaust if they go all the way to the House of Lords.<br /><br />Meanwhile, round two of the Karen Murphy case is set to kick-off this afternoon.<br /><br /><br />]]></description></item><item><title>OBG LLP Wins First Round (21-05-2008 01:14:16)</title><author>KIDDER11</author><link>http://lamps.forumco.com/topic.asp?whichpage=-1&amp;TOPIC_ID=52&amp;REPLY_ID=71</link><ttl>10</ttl><pubDate>Wed, 21 May 2008 01:14:16 +0100</pubDate><description><![CDATA[ There are 2 replies, with the last one on 21/05/2008 at 01:14:16 by KIDDER11]]></description></item></channel></rss>
